Welcome to PK27 Performance Medicine (“PK27”, “we”, “our”, “us”). By accessing or using our services, you agree to be bound by these Terms of Service (the “Terms”), our Privacy Policy, and any additional policies we notify you of from time to time.
Please read these Terms carefully. They set out your responsibilities, our responsibilities, and the limits of our obligations to you.
- Scope of Services
Through PK27 Performance Medicine, you may access:
- Performance-focused health assessments
- DNA and epigenomic testing (via third-party labs)
- Personal Health Reports integrating lifestyle, training, and test results
- Telehealth consultations with qualified medical practitioners
- Health coaching, data interpretation, and program coordination
- Educational content, reports, videos, and digital tools
We provide these services through our digital platform, in-person consultations, and secure delivery partners.
Important:
- DNA results are yours — PK27 does not own, sell, or repurpose your genomic data. You may choose to share your DNA results with us for interpretation.
- Epigenomic tests are de-identified — these results are used for performance insights and research but cannot be traced back to you.
- Performance focus — our services are designed to optimise healthspan and performance, not to diagnose or treat medical conditions in isolation.
- Eligibility
To use PK27 services, you must:
- Be at least 18 years of age
- Register for an account with accurate details
- Consent to these Terms and to receive telehealth services
- Be physically located in Australia when receiving clinical telehealth services
We reserve the right to decline or terminate services if they are not clinically appropriate for you.
- Telehealth Consent
By using our services, you consent to consultations delivered via telehealth (video, phone, or digital messaging).
This may include:
- Transmission of health records, photos, data from wearables, or test results
- Virtual examination
- Involvement of additional providers (e.g., health coaches, lab staff) in your care
You acknowledge that telehealth carries inherent risks, including limitations in assessment and diagnosis. You may withdraw consent at any time, but this may affect your access to services.
- Payment, Cancellation & Refunds
- Program Fees
When you enrol in PK27, you agree to pay the program fee applicable to your chosen package. This covers access to performance medicine services, coordination, coaching, and your annual consultation.
- Medicare Billing
- Clinical services provided under PK27 may be billed through Medicare at the rate of $1,200 per hour.
- Any rebates from Medicare are retained by you (the patient).
- PK27 does not retain Medicare rebates on your behalf.
- Financial Responsibility
- Your total financial obligation to PK27 will not exceed your program fee, regardless of the number of clinical consultations billed to Medicare.
- If a Medicare rebate does not fully cover a service, PK27 will not charge you additional amounts above your program fee.
- PK27 does not submit claims to private health insurers on your behalf. Patients are responsible for checking if their insurer provides reimbursement.
- Minimum Commitment:
- By enrolling, you commit to at least six months of services. If you cancel before this period, no refunds will be issued.
- Cancellation:
- You may cancel by emailing reception@pk27.com with the subject line: “CANCELLATION NOTICE – PK27”
- A minimum of 1 months notice is required.
- Cancellations received later will take effect the following billing cycle.
- Refunds:
- Refunds are at our discretion, except where required by law.
- Processing fees (typically 3%) may be deducted from refunds.
- No refunds will be provided for services already delivered.
- Acceptable Use
You agree to:
- Provide accurate and complete information
- Keep your login details secure
- Use PK27 services only for personal, non-commercial purposes
- Not misuse or attempt to interfere with our platform or services
- Not harass, abuse, or engage in inappropriate conduct towards PK27 staff or practitioners
- Not use our services for emergencies — call 000 if you require urgent medical attention
- Medical Disclaimer
PK27 Performance Medicine provides performance-focused health services, not acute emergency care.
- Health coaches do not diagnose, treat, prescribe, or replace medical providers.
- Genomic and lifestyle advice is for optimisation and education purposes.
- Only licensed practitioners engaged by PK27 may provide clinical healthcare services.
- You should always consult a qualified medical professional regarding serious or urgent medical concerns.
- Intellectual Property
PK27 retains all rights in its platform, content, and materials. You may not copy, distribute, or commercialise our materials without written consent. This does not apply to your personal health data, which you own.
- Limitation of Liability
To the extent permitted by Australian law:
- PK27 and its practitioners are not liable for indirect, incidental, or consequential damages.
- Our liability is limited to the resupply of services or the cost of resupply, as provided under the Australian Consumer Law.
- Indemnity
You agree to indemnify PK27, its staff, and contractors against claims arising from your misuse of the services, breach of these Terms, or reliance on non-clinical information provided through our programs.
- Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
- Force Majeure
PK27 will not be liable for delays or failures caused by events beyond our reasonable control, including pandemics, natural disasters, or technology outages.
- Entire Agreement
These Terms, together with our Privacy Policy and any additional program-specific terms, constitute the entire agreement between you and PK27.
